Lawsuit Alleges Skill-Based Games Platform Used Bots in Human-vs-Human Games

A class-action lawsuit filed in Texas claims that Avia Games, a skill-based games platform, utilized bots in games that were supposed to be played between humans. The lawsuit follows a previous legal action by Skillz, which accused Avia Games of copying its skill-based games that allow players to wager money on the outcomes. These games are considered legal as they are based on skill rather than chance. However, if players are unknowingly competing against bots instead of real humans, it raises concerns about illegal gambling practices. The class-action suit also adds allegations of racketeering and fraud to the case.

The lawsuit was initiated by Andrew Pandolfi and Mandi Shawcroft, who claim to have collectively lost thousands of dollars on Avia Games platforms. They argue that they would not have spent this money if they had known they were playing against bots. The class-action lawsuit asserts that Avia Games falsely presents its platform as a place for users to compete against real people, when in reality, computer bots populate and control the games. This manipulation turns the advertised skill-based games into games of chance, constituting an unapproved gambling enterprise.

The class-action lawsuit references information discovered by Skillz in their own allegations against Avia Games. The Skillz vs Avia Games lawsuit is scheduled for trial on February 2, 2024. The plaintiffs in the class-action suit seek consumer protection claims under Californian law for Avia’s deceptive and unfair business practices, as well as violations of the RICO statute.
